Common Good

 

What is Common Good ? In its simplest form it’s a ‘legacy’ - Common Good is land, property and money that was part of the Royal Burgh, the assets of the town council and anything that was gifted to the people of Forres by people living in Forres who wanted to contribute to the future of the town.  It was administered by the town council before the 1975 regionalisation of local authorities when it passed firstly to the Regional/ District Council (Grampian/Moray) then to the Moray Council after the abolition of regional government.

 

Common Good may be defined as assets that are to be used for the benefit of the town and the residents of it. Common Good in Moray is held in trust by The Moray Council with the local councillors as the trustees. The Forres Common Good includes Bogton and Kingsmeadows.

 

Common Good law is based on 'Case Law' and can be very complex. Solicitor Andrew C Ferguson is the leading authority and his book Common Good Law (published by Avizandum) is recognised as the only authoritive guide.

 

Andy Wightman is an independent writer and researcher on issues of land and democracy with a particular interest in community land rights.  and who has done a great deal of research on Common Good and acts as a consultant on the subject.
